Terms of Service

These Terms of Service (“Terms”) govern your use of the website (gorally.in) (“Platform”) that is owned, operated, and managed by Playaccess Facilities and Tech Private Limited (hereinafter referred to as (“GoRally”, “we”, “us”, “our” or similar). In these Terms, “you”, “your” (or similar) shall refer to any natural or legal person visiting our Platform and/or using Services (defined below) as available on the Platform.

By visiting our Platform and/or using any of the service offerings on the Platform, you engage in our Services and agree to be bound by the following Terms, including those additional terms and conditions and policies referenced herein and/or available by hyperlink, as amended from time to time. These Terms apply to all visitors and users of the Platform, including but not limited to users who are browsers, visitors, customers, merchants, partners, and/or contributors of content.

These Terms shall be read in conjunction with the Privacy Policy and any other related policy, or additional terms and conditions and policies referenced on our Platform and/or available by hyperlink throughout the Platform, as amended and published on the Platform from time to time (“Agreement”). Please read these Terms carefully before accessing or using the Platform. By accessing or using any part of the Platform, you automatically and perpetually agree to be bound by these Terms. If you do not agree to any of the terms and conditions of these Terms, then you may not access the Platform or use any Services.

• (i) Open play, including booking of courts or ‘join a game’ through the Platform or offline at our Pickleball Facilities (defined below);
• (ii) Events (defined below) offered by us;
• (iii) Coaching sessions at our Pickleball Facilities;
• (iv) Renting equipment at our Pickleball Facilities;
• (v) Submitting your data on the Platform;
• (vi) Using any third-party sites through our Platform or offline/indirectly by using the Services,
• (vii) Initiating any other engagement with us through our Platform; or
• (viii) Any other related services offered directly or indirectly by GoRally, including but not limited to building/engaging in digital or offline communities or groups or meetups; (collectively defined as “Services”).

Upon each visit or use of the Platform, including but not limited to registering on the Platform in the manner permitted hereunder, or upon you accessing or providing any information to us, you agree to engage in our Services and be bound by this Agreement. We offer this Platform, including all information and our Services to you, conditioned upon your acceptance of this Agreement.

By agreeing to these Terms, you represent that you are at least 18 (Eighteen) years of age. Minors may only access the Platform with the express consent and under direct supervision of a parent or legal guardian who: (i) explicitly agrees to be bound by these Terms; (ii) assumes full responsibility for the minor’s use of the Platform, including all bookings, payments, and compliance with these Terms; and (iii) acknowledges and accepts all risks associated with the minor’s participation in sports activities booked through the Platform. We shall not be liable for any injuries, damages, or losses arising from such activities, and the parent or guardian expressly waives any claims against us in this regard. We reserve the right to suspend or terminate any account if it is determined that a minor has registered without proper consent. If you believe a minor has accessed the Platform without authorization, please contact support@gorally.in.

We reserve the right to restrict providing our Services at any time, for any lawful reason, and without notice, at our sole discretion. We also reserve the right to withdraw or amend the Platform, and any Service or material provided on the Platform, or update, change or replace any part of these Terms, at any time, for any reason, and without notice, at our sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

• (i) This Platform contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction, in any form or manner, is prohibited other than in accordance with the copyright notice, which forms part of these Terms. Unauthorized use of this Platform may give rise to a claim for damages and/or be a criminal offense. From time to time, this Platform may also include links to third party websites. These links are provided for your convenience to provide further information. They do not signify that we endorse these website(s). We have no responsibility for the content of the linked third-party website(s). Certain content, products or services available via our Service may include materials from third parties. Third- party links on this Platform may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties. You acknowledge and agree that the use of any linked site is governed by such third party’s terms of use, license agreement, privacy policy, and / or any other agreement specified in such linked site. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please re-view carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. This Platform and all contents herein are provided on an ‘AS-IS’ basis, without warranties of any kind, either express or implied, including without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose.
• (ii) You acknowledge that your use of the Platform is at your sole risk, you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of the Platform, and that we shall not be liable for any damages of any kind related to your use of this Platform.
• (iii) The content of the pages of this Platform is for your general information and use only. It is subject to change without notice.
• (iv) Unauthorised use of this Platform may give rise to a claim for damages and/or be a criminal offence.
• (v) Your use of this Platform and any dispute arising out of such use of the Platform is subject to the applicable laws.

When you use the Platform or our Services, you agree to use the Platform and our Services only for purposes that are permitted by these Terms and any applicable law, regulation, circulars, or guidelines. In addition, you agree that you are solely responsible for any breach of your obligations under these Terms, and for the consequences (including any loss or damage which we may suffer) of any such breach.

You, either on your own or on behalf of any third-party, agree not to:

• (i) Access or attempt to access our Services and content other than through our Platform, unless you have specifically been permitted to do so in a separate written agreement signed by an authorized representative of GoRally;
• (ii) Access or attempt to access the Platform, or any portion thereof, through any automated means, including but not limited to the use of scripts or web crawlers;
• (iii) Engage in any activity that disrupts or otherwise interferes with the Platform (or the servers and networks which are connected to the Platform), or our Services;
• (iv) Scrape, duplicate, reproduce, copy, republish, license, sell, trade, or resell the Platform for any purpose; use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us;
• (v) Divert or attempt to divert GoRally’s customers to another Platform, mobile application, or service;
• (vi) Send unsolicited or unauthorized emails on our behalf, including promotions and/or advertising of our Services;
• (viii) Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Platform;
• (ix) Transmit any worms or viruses or any code of a destructive nature through the use of this Platform;
• (x) Attempt to do anything, or encourage, assist, or allow any third-party to do anything in violation of these Terms;
• (xi) Use a false email address, impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Platform or our Services;
• (xii) Use our Services for any illegal or unauthorized purpose or violate any applicable laws or regulations in your use of our Services; and
• (xiii) Not to host, display, upload, modify, publish, transmit, store, update or share any information with us that:
  • a) Belongs to another person and to which you do not have any right;
  • b) Is obscene, pornographic, paedophilic, invasive of another's privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or an online game that causes user harm, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
  • c) Is harmful to children;
  • d) Infringes any patent, trademark, privacy, copyright or other proprietary rights of a third party;
  • e) Comments will not contain libelous or otherwise unlawful, abusive or obscene material;
  • f) Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information that is patently false and untrue or misleading in nature or, in respect of any business of the Central Government, is identified as fake or false or misleading by such fact check unit of the Central Government as the Ministry of Electronics and Information Technology may, by notification publish in the circulars or notices or Official Gazette;
  • g) Impersonates another person;
  • h) Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offence, or prevents investigation of any offence, or is insulting other nation;
  • i) Contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of our Services and/ or Platform;
  • j) Is in the nature of an online game that is not verified as a permissible online game;
  • k) Is in the nature of advertisement or surrogate advertisement or promotion of an online game that is not a permissible online game, or of any online gaming intermediary offering such an online game; or
  • l) Violates any law for the time being in force.

TO THE EXTENT PERMITTED BY LAW, GORALLY WILL NOT BE LIABLE IF FOR ANY REASON ALL OR ANY PART OF THE PLATFORM IS UNAVAILABLE AT ANY TIME OR FOR ANY PERIOD FROM TIME TO TIME. WE MAY RESTRICT ACCESS TO SOME PARTS OF THE PLATFORM, OR THE PLATFORM ENTIRELY, TO USERS, INCLUDING REGISTERED USERS.

You may choose to create a unique account on the Platform using your registered mobile number and one-time-password (“GoRally Account”). During the registration process, you will be required to provide personal information in line with the Privacy Policy. You agree and undertake to provide true, accurate, current, and complete information to us at all times. Unless permitted here otherwise, each GoRally Account can be used by only one registered user. You may choose to create a GoRally Account by registering your corporate entity on the Platform by providing information in line with the Privacy Policy (“Registered Entity”). You are solely responsible for the confidentiality and use of GoRally Account, as well as for any use, misuse, or communications entered through the Platform using one or more of them. You will promptly inform us of any need to deactivate your GoRally Account or make any changes thereof. We reserve the right to delete, restrict, suspend or terminate your GoRally Account at any time and for any reason. We will not be liable for any loss of data or damage caused by any unauthorized use of your GoRally Account.

We are not responsible if information made available on this Platform is not accurate, complete or current. The material on this Platform is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This Platform may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this Platform at any time, but we have no obligation to update any information on our Platform. You agree that it is your responsibility to monitor changes to our Platform.

You may book a court or ‘join a game’ using the Platform by selecting from our available Pickleball centres across the available city(ies) (“Pickleball Facility”). You can choose your preferred date and time slot based on availability. Upon making your selection, you will be redirected to a third-party payment page (see section 10 below). Once your payment is processed to ‘book a court’ or ‘join a game’, you will be subject to the additional terms and conditions of the Pickleball Facility hosting your game. These terms and conditions will be (i) displayed on the booking page of the Platform before you proceed to the payment page; and (ii) where applicable, displayed at the Pickleball Facility hosting your game. You are required to thoroughly read, understand and accept Sections 16 and 17 hereunder, prior to using the open play service offered by GoRally.

We may, from time to time, directly or indirectly, individually or in collaboration with third parties, organise, conduct and/or manage events, tournaments, leagues, competitions or related activities at our Pickleball Facilities (“Events”). Participation in such Events is purely voluntary, and you agree to comply with all applicable rules, regulations, and eligibility criteria set forth by us or any third-party organizer. By registering or participating in an Event, you agree to be bound by the specific terms and conditions that govern that Event (which may change for each Event, each Pickleball Facility and each third party organizer). Failure to comply with any of these requirements may result in disqualification, suspension, or forfeiture of any prizes, at our sole discretion, without any refund or compensation to you. We make no representations or warranties regarding the fairness, integrity, organization, or outcomes of any Event. You are required to thoroughly read, understand and accept Sections 16 and 17 hereunder, prior to participating in any Events.

You may choose to connect with certified coaches through the Platform and take coaching/ training sessions at the Pickleball Facilities that offer this service. The selection of coaches, trainers, and training programs is solely at our discretion, and we reserve the absolute right to add, remove, or modify the availability of any coach, trainer, session, or facility at any time without prior notice.

While we strive to offer high-quality coaching services, we do not guarantee the availability, skill level, or teaching style of any coach or trainer. You acknowledge that each coach or trainer operates independently, and we do not assume liability for the methodology, approach, or effectiveness of their training. You agree and acknowledge that the training and coaching sessions shall be subject to specific terms and conditions that you agree to be bound by. Failure to conform with the applicable rules and regulations, including but not limited to continuous misbehaviour with the coach/ trainer or other members present at the Pickleball Facility, chronic absenteeism, may lead to cancelation or suspension of the coaching services provided to you without any refunds whatsoever.

We reserve the right to modify, reschedule, replace, or discontinue any coach, trainer, session, or facility at our sole discretion, without prior notice or obligation to inform you. This includes, but is not limited to, changes in pricing, session structure, coach availability, or training methodologies.

Participation in any coaching or training session is at your own risk. You acknowledge that physical training, sports activities, and related exercises involve inherent risks of injury, strain, or other physical harm. We expressly disclaim all liability for any injuries, losses, or damages arising from your participation in coaching sessions.

You are required to thoroughly read, understand and accept Sections 16 and 17 hereunder, prior to using the coaching service offered by GoRally.

You may purchase and/or rent Pickleball-related equipment exclusively at our centres. We provide information about Pickleball-related equipment, including photographs of equipment and world- renowned players of Pickleball and Paddle, solely for informational purposes. You are required to conduct your own assessment prior to making a purchase. We do not guarantee, represent, or warrant that the content is accurate, complete, reliable, or up to date. The images and information displayed on the Platform are for educational and reference purposes only. The inclusion of any player images, equipment details, or brand names does not imply any endorsement, sponsorship, or affiliation with the respective players, manufacturers, or brands, unless explicitly stated otherwise. We do not manufacture any of the products displayed on the Platform. Any representations, specifications, or descriptions of equipment are provided based on publicly available information or third-party sources, and we do not warrant their accuracy, quality, suitability, or performance. You are advised to verify all details independently before making any purchase or decision. All images, product descriptions, and player details may be sourced from third parties. We disclaim any responsibility for errors, omissions, or inaccuracies in such third- party content. Any reliance placed on such information is strictly at your own risk.

If any equipment provided by us or rented from us is damaged, broken, lost, or rendered unusable due to your actions, negligence, or omissions, you shall be solely responsible for (i) the cost of repair, or (ii) if the damage is beyond repair, then the full replacement cost of the damaged item. GoRally reserves the right to charge you for the actual damage incurred by GoRally, and invoice you separately for this purpose. You waive all claims in this regard. Before using any equipment provided at any Pickleball Facility, you are encouraged to inspect it for any visible defects or issues. If you notice any defects or concerns, you must immediately report them to the Pickleball Facility management before use. Failure to report a defect before use may result in you assuming responsibility for any damages or injuries caused by the equipment.

If you play using your own equipment or equipment not rented/ provided by us, you fully understand, acknowledge and accept that GoRally shall not be liable for any loss, damage, or defects in such equipment. You shall assume all risk associated with using such equipment.

You are required to thoroughly read, understand and accept Sections 16 and 17 hereunder, prior to using any equipment at a Pickleball Facility.

• (i) All payments on the Platform, including payments made to book a court, ‘join a game’ or pre- register for an Event, will be undertaken by our third-party payment partner. By making a payment, you agree to be bound by the terms and conditions of our third-party payment partner, including those governing refunds and cancellations. You are required to thoroughly review and understand our Privacy Policy and the third-party payment related terms and conditions prior to making any payments. You represent and warrant that the information provided by you is accurate and complete and you are authorized to make payments for our services and use the available payment methods to purchase our services.
• (ii) Please direct all your queries regarding delayed refunds, chargebacks, payment failures and double debits to your payment service providers.
• (iii) We reserve the right to refuse any Service to you if you infringe any terms and conditions specifically pertaining to the Service you have purchased.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new Services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms, as amended from time to time.

None of the provisions of these Terms shall be deemed to constitute a partnership or agency between you and GoRally and you shall have no authority to bind us in any manner whatsoever nor shall we have any authority to bind you in any manner whatsoever. All the Services provided by us shall be as independent contractor and on a principal-to-principal basis. Further, we reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

We collect, store, process and use your information in accordance with our Privacy Policy. By using the Platform and/ or by providing your information, you consent to the collection and use of the information you disclose on our Platform in accordance with the Privacy Policy.

Occasionally there may be information on our Platform or in the Service that contains typographical errors, inaccuracies or omissions that may relate to descriptions, pricing, promotions or offers. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by applicable law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

In addition to other prohibitions as set forth in the Terms, you are prohibited from using the Platform or its content:

• (i) For any unlawful purpose;
• (ii) To solicit others to perform or participate in any unlawful acts;
• (iii) To violate any international, domestic or state regulations, rules, laws, guidelines or local ordinances;
• (iv) To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
• (v) To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
• (vi) To submit false or misleading information;
• (vii) To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;
• (viii) To collect or track the personal information of others;
• (ix) To spam, phish, pharm, pretext, spider, crawl, or scrape;
• (x) For any obscene or immoral purpose; or
• (xi) To interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

These disclaimers are applicable to all visitor and users of any Pickleball Facility, and to all users of the Platform.

• (i) By using or visiting a Pickleball Facility, including but not limited to for open play, coaching sessions, Events, or any other purpose, you acknowledge and agree that participation in sports activities carries inherent risks, including but not limited to physical injury, illness, damage to personal property, serious injury, permanent disability or death. You voluntarily assume all such risks associated with your presence at and use of any Pickleball Facility, whether occurring before, during, or after play, training, or any Event at the Pickleball Facility. We are not responsible for any injuries, accidents, or medical conditions arising from your participation in any game, practice, coaching session or other activities, including visitation at any Pickleball Facility. This includes, but is not limited to, slips, falls, collisions, muscle strains, or any other physical harm sustained while playing.
• (ii) If you participate in coaching sessions offered at any Pickleball Facility, you acknowledge that coaching involves physical activity and carries the risk of injury. We do not provide any warranties regarding the effectiveness or safety of the coaching sessions. You agree that we shall not be held liable for any injuries or damages incurred during or as a result of coaching. Should you participate in any Event, competition, or tournament hosted at any Pickleball Facility, you do so at your own risk. We do not guarantee the safety or security of participants, spectators, or personal belongings during such Events and disclaim all liability for injuries, accidents, or damages.
• (iii) By visiting or using any Pickleball Facility, whether as a player, spectator, or guest, you agree that we shall not be liable for any injuries, accidents, theft, loss of personal property, or any other damages that may occur on the premises, including in parking areas, restrooms, locker rooms, and common areas.
• (iv) We do not assume any responsibility for injuries, accidents, or medical conditions, including but not limited to sprains, fractures, concussions, cardiac incidents, paralysis, or fatal injuries that may occur during (a) playing or practicing the sport, (b) coaching sessions, (c) Events, (d) use of equipment, (e) presence at a Pickleball Facility for any reason whatsoever. We do not provide medical services or assume any responsibility for medical care in the event of an injury. In case of an emergency, you should seek medical attention at your own expense. You acknowledge that we are not liable for any delay or failure in receiving medical assistance while at any Pickleball Facility.
• (v) Any equipment provided by us or available for use at any Pickleball Facility, including paddles, balls, nets, and other gear, is used at your own risk. We do not warrant that the equipment is free from defects, and we disclaim all liability for any injuries or damages caused by the use of such equipment. You acknowledge that sports equipment inherently carries risks, and its condition may be affected by prior usage, wear and tear, or unforeseen defects. We do not warrant, represent, or guarantee that the equipment is in perfect condition, free from defects, or suitable for any particular purpose. The equipment is provided “as is” and “as available” basis, without any express or implied warranties, including but not limited to non-infringement, merchantability, fitness for a particular use, and freedom from defects or damage.
• (vi) To the fullest extent permitted by law, you hereby release, discharge, and hold harmless GoRally, its directors, shareholders, employees, coaches, staff, agents, representatives and affiliates from any and all claims, liabilities, damages, costs, or expenses (including legal fees) arising out of or in connection with your use of any Pickleball Facility or, participation in activities, or use of provided equipment. GoRally shall not be liable for any personal injury, permanent disability, or death that may occur at any Pickleball Facility, except to the extent caused solely by GoRally’s gross negligence or wilful misconduct.
• (vii) In no event shall GoRally or its affiliates and sub-contractors be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including but not limited to, damages for loss of profits, revenue, goodwill, use, data or other intangible losses whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service, or for any other claim related in any way to your use of the Services, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
• (viii) In addition to any limitation of liability and various disclaimers provided elsewhere in these Terms, GoRally’s entire liability and your sole and exclusive remedy in any circumstance is limited to the aggregate fees paid by the user/customer during a period of 2 (two) months preceding the event of default.
• (ix) RELEASE FORM:

  To the fullest extent permitted by law, you irrevocably waive, release, and discharge GoRally, its directors, shareholders, officers, employees, coaches, staff, agents, representatives, and affiliates from any and all claims, liabilities, damages, or expenses, including those related to serious injury, permanent disability, or death, arising out of or in connection with:

  
  
  • (a) participation in sports or training activities;
  • (b) presence at any Pickleball Facility,
  • (c) use of equipment, whether provided by us or a third party.

You shall fully indemnify, keep indemnified, defend, and hold harmless GoRally and its shareholders, subsidiaries, affiliates, third-parties and their respective shareholders, officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms or any rules and policies contained herein, or your violation of any law, rules or regulations or the rights of a third party or applicable law.

If any clause of these Terms shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of these Terms and such determination shall not affect the validity and enforceability of any other remaining provisions. These Terms sets forth the entire understanding and agreement between you and GoRally with respect to the subject matter hereof

Your obligations and liabilities prior to the termination date shall survive the termination of this Agreement for all purposes. By accepting these Terms and/or by utilising the Platform, you agree to enter into a legally binding agreement between yourself and GoRally. We may terminate your Agreement with us at any time upon a violation or breach of this Agreement, or any part thereof. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this Agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

This Agreement constitutes the entire agreement and understanding between you and us and govern your use of the Platform, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

These Terms and all the rules and policies contained herein and any of your usage of Platform and your dealings with GoRally shall be governed and construed in accordance with the laws of India and will be subject to the jurisdiction of the courts in Bengaluru.

If any dispute arises between you and GoRally during your use of the Platform or your dealing with the GoRally in relation to any activity on the Platform, in connection with the validity, interpretation, implementation or alleged breach of any provision of the Terms and all the rules and policies contained herein, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by GoRally. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language. The place of arbitration shall be Bengaluru.
